Our Commitment to Compliance

Budbo is committed to operating in full compliance with all applicable federal, state, and local laws governing cannabis, THC-A, CBD, and hemp-derived products. We work exclusively with licensed dispensaries and retailers to ensure safe, legal access across all product categories.

Under The 2018 Farm Bill

The Agricultural Improvement Act of 2018 (Farm Bill) legalized hemp and hemp-derived products containing less than 0.3% Delta-9 THC by dry weight. This federal law removed hemp from the Controlled Substances Act and enabled the legal sale of hemp-derived cannabinoids including THC-A, CBD, and other naturally occurring compounds.

All Budbo products contain less than 0.3% Delta-9 THC and are compliant with federal regulations under the 2018 Farm Bill.

We Ship to 45 States

We proudly ship our federally legal hemp-derived products to all states where permitted by law.

Due to state-specific regulations, we cannot ship to the following states:

Important: Federal Hemp Law Changes (November 2026)

On November 12, 2025, Congress enacted P.L. 119-37, which significantly changes the federal definition of hemp. Effective November 12, 2026:

  • Hemp definition changes from delta-9 THC only to total THC (including THC-A)
  • Final products capped at 0.4mg total THC per container
  • Synthetic cannabinoids (Delta-8, Delta-10, THC-O) become controlled substances
  • Many current THC-A flower products will no longer qualify as legal hemp

President Trump's December 2025 executive order may lead to revisions of these limits. We will update our compliance program as regulations evolve.

Product Categories We Cover

Recreational Cannabis (THC)

Adult-use cannabis products available in 24 states + DC. Requires 21+ age verification and purchase through licensed dispensaries.

Medical Cannabis

Medical marijuana programs in 40 states. Requires valid medical card/recommendation and compliance with state-specific conditions.

THC-A Flower

Hemp-derived THC-A products. Legal status varies significantly by state. Subject to major federal changes in November 2026.

CBD Products

Hemp-derived CBD with <0.3% THC. Federally legal under 2018 Farm Bill. State regulations vary for consumables and topicals.

Age Verification Requirements

Licensing and Partnerships

Budbo partners exclusively with dispensaries and retailers that hold valid state and local licenses. Our partner verification process includes:

  • Ongoing monitoring of license status
  • Regular compliance assessments

Product Testing Standards

All cannabis products sold through our platform must meet rigorous testing requirements:

Certificate of Analysis (COA) Requirements

  • Potency Testing: THC, THC-A, CBD, and other cannabinoid content
  • Contaminant Screening: Pesticides, heavy metals, microbial contaminants
  • Residual Solvents: For concentrate and extract products
  • Terpene Profiles: When available
  • Moisture Content: For flower products

All testing must be performed by state-licensed testing laboratories. COAs should be available for all products; contact the dispensary for specific product test results.

Packaging and Labeling Compliance

Products sold through Budbo must comply with state packaging and labeling requirements:

  • Child-resistant packaging
  • Tamper-evident seals
  • Clear THC/THC-A/CBD content labeling
  • Universal symbol warnings where required
  • Batch and lot numbers for traceability
  • Licensed producer information
  • Required health warnings and disclaimers

Seed-to-Sale Tracking

Our dispensary partners participate in state-mandated seed-to-sale tracking systems, including but not limited to:

  • METRC (Marijuana Enforcement Tracking Reporting Compliance)
  • BioTrack
  • Leaf Data Systems
  • State-specific tracking platforms

These systems ensure full traceability of cannabis products from cultivation through retail sale, supporting compliance and consumer safety.

Advertising Compliance

Budbo's advertising and marketing practices comply with state regulations:

  • No marketing to individuals under 21
  • No false or misleading health claims
  • Required disclaimers on all advertising
  • Age-gating on digital platforms
  • Compliance with platform-specific policies

Data Compliance

We maintain compliance with data protection regulations including:

  • CCPA: California Consumer Privacy Act
  • State Privacy Laws: Virginia, Colorado, Connecticut, and other state privacy regulations
  • Cannabis Industry Record-Keeping: State-specific requirements for transaction records and customer data
